STANDARD TERMS & CONDITIONS

1. Bookings
Once a provisional booking has been agreed upon a deposit is due by the required date to confirm the reservation. Under certain circumstances credit card information may be required to confirm the reservation until the deposit has been received. Should the deposit not be forthcoming a charge of $100 may be made payable by the client. A credit of $50 will be made should the reservation be confirmed at a later date. Confirmation of your reservation will be sent on receipt of the deposit. The issue of this confirmation constitutes a contract between the Owner and the Client.

2. Payments
If the booking is made within five weeks of departure full payment is required unless other terms are agreed upon. A minimum deposit of $250 per week is required, at the time of booking, and the balance (full amount if the deposit is a security deposit) is due as follows:
1) 5 weeks before arrival for regular check or
2) A post dated check - 4 weeks before( which we will gladly return before due date if you request it) with your deposit or
3) 3 weeks before arrival by fedex and cashiers check
unless other terms have been agreed upon in writing. Upon receipt and clearance of final payment the owner will provide an email detailing the checkin procedures. A security deposit in the form of a check or credit card may also be required. This will be refunded once our suite has been inspected and we have received a report from the property manager. In the event of full payment not being made by the due date the Owner reserves the right to cancel the booking and any deposits will be forfeited. A $75 charge will be made should the reservation be reinstated by the owner after the due date and for NSF checks. All prices quoted are cash discounted, PayPal transactions if previously agreed to by the owner will add a $55 convenience fee plus a 5% fee charge

3. Accommodation
Access to the property is available after 4.00 pm on the first day of rental and must be vacated by 10:00 am on the agreed departure date unless otherwise agreed upon in writing. This allows cleaning and preparation for the next guests to take place. The property is reserved exclusively for the number and those people named on the booking form and no other persons are permitted to stay there unless this has been agreed in writing with the Owner prior to the rental period. One parking space ( campers, boats and trailers not allowed ) is included, if an additional space is required the client will notify owner in advance. If available additional charges may apply. Rates quoted are for a maximum of 5 persons unless otherwise stated. It should be noted especially by persons with disabilities that our Madeira Beach condo is on the 5th floor and in case of elevator maintenance, repairs or emergencies the client will be required to use the stairs for access or egress. Our Disney villa is on the second floor and is accessible by stairs only. The client will notify the owner immediately should they find any problems with the accommodation, the owners only liability will be to try to correct the problems as quickly as possible and the client agrees to accept this as the best solution. Under no circumstances will any animals be allowed in the home (except with the permission of the Owner in writing). Pet deposits are nonrefundable. The Owner requests that smoking be refrained upon inside the home. Smoking is allowed on the balconies.

4. Changes made by the Client
The Owner will endeavour to facilitate any minor changes to the reservation requested by the client after the booking has been confirmed. The alteration will be effective as soon as the Owner sends written confirmation to the Client of the change. The Client may incur additional costs for changes to the reservation depending on the alternative dates requested and when requested.

5. Cancellations made by the Client
Cancellations must be made by email. Cancellations will become effective from the delivery date of the cancellation letter. All cancellations are subject to a charge payable by the Client as detailed below.
Cancellation received:
More than 7 weeks - $150 or deposit less $100 whichever is the greater
more than 5 weeks - Deposit
less than 5 weeks - 100%.
If cancellation insurance has been purchased then a refund will only be issued when a member of the party is unable to travel due to an emergency medical condition. A signed Doctors certificate is required for the refund and notification by email is required up to 3 days before arrival for such refund.

6. Changes / Cancellations made by the Owner
If the rental home should become unavailable, then alternative accommodation will be provided if available, or if not available then compensation, as determined by the owner, will be limited to a refund and/or credit not to exceed in total the monies paid paid unless the change/cancellation arises from reasons of 'Force Majeure'.

7. Feed Back
The owner welcomes feedback from the client as to their enjoyment of our vacation homes. This helps the owner to improve service and maintain our vacation home to satisfactory standards.

8. Liabilities
The Owner does not accept any responsibility or liability for acts or omission of third parties which may prevent or disrupt a client's booking. The booking contract exists between the owner and the client and is limited to the rental of the unit. No liability can be accepted by the Owner for any injury, loss or damage to the Client, any member of the Clients Party or any visitor to the rental home, arising out of or in connection with the use of the rental home or the pool. The Client must ensure that all Children are supervised at all times whilst in or around the pool.

9. Force Majeure
The Owner can accept no liability where the contract is affected by 'force majeure'. In the context of these terms and conditions, 'force majeure' is any event that the Owner or the property management company could not foresee or avoid. These events include but are not limited to war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, acts of God, terrorist activity, nuclear disaster, adverse weather, government action, technical problems with transportation, equipment, access, facilities or other events outside the Owners control. The Owner, at his sole discretion, may issue a credit in an amount determined by the Owner for any time lost should the home become unavailable.

10. Changes to the Terms and Conditions
The client agrees that by making payment of the deposit they have read and agree to these terms and conditions in there entirity. Changes to the above Terms and Conditions can only be with the written consent of both the Client and Owner.
